These Terms of Service are a binding agreement between you and Fieldwork Software Co. for Kiln. By creating an account, accessing Kiln, or using any Kiln feature, you agree to these terms.

If you use Kiln for a company, client, or other organization, you represent that you have authority to bind that organization. In that case, "you" includes both you and that organization.

You must be at least 18 years old to use Kiln. You may not use Kiln if you are barred from using the service under applicable law or if we previously suspended or terminated your account for cause.

Workspace owners and administrators are responsible for organization settings, membership, permissions, and activity by users they invite or authorize.

Kiln helps teams analyze product links, product photos, brand context, campaign direction, uploaded media, and related inputs to generate marketing assets, previews, videos, and supporting materials.

Kiln is evolving. We may add, change, limit, suspend, or discontinue features, providers, models, integrations, or output formats. We may also impose reasonable usage, storage, rate, or safety limits.

• Provide accurate account and workspace information.
• Keep login links, sessions, credentials, and devices secure.
• Tell us promptly if you believe your account or workspace has been compromised.
• Remain responsible for activity under your account, except to the extent caused by Fieldwork's breach of these terms.

You keep ownership of product information, product URLs, images, videos, briefs, campaign direction, brand materials, feedback, and other content you submit to Kiln.

You grant Fieldwork a limited license to host, copy, process, transmit, display, modify, create derivative works from, and otherwise use customer content as needed to provide, secure, maintain, debug, support, and improve Kiln.

You represent that you have all rights and permissions needed to submit customer content to Kiln and to allow Kiln and its providers to process it.

Subject to your rights in customer content, third-party rights, provider terms, and applicable law, Fieldwork assigns to you the rights it has in generated outputs created for your workspace through Kiln.

AI and media-generation systems can produce inaccurate, unexpected, incomplete, or similar outputs for different users. You are responsible for reviewing outputs before using them, including for accuracy, claims, rights, clearances, compliance, and suitability for your campaigns.

Fieldwork does not use private customer content to train general-purpose AI models for others and will not use your private customer content or outputs in public marketing without your permission.

• Do not use Kiln illegally, deceptively, or to violate another person's rights.
• Do not upload content you do not have rights to use.
• Do not submit Social Security numbers, payment card details, health information, children's data, or other regulated sensitive information.
• Do not create or distribute child sexual abuse material, explicit sexual content, non-consensual intimate content, hateful or harassing content, or content that promotes violence or self-harm.
• Do not use Kiln for political persuasion, impersonation, fraud, malware, spam, surveillance, weapons development, or professional advice in regulated fields such as legal, medical, financial, or employment decisions.
• Do not reverse engineer, scrape, overload, interfere with, or bypass security, access controls, rate limits, or usage limits.

Kiln relies on third-party services and providers, including infrastructure, storage, analytics, email, support, commerce, browser-rendering, AI, media-generation, and integration providers. Third-party services may be subject to their own terms and policies.

If you connect Shopify or another integration, you authorize Kiln to access and process the connected information needed to provide that integration. You can disconnect integrations when supported by Kiln or the third-party service.

The Shopify integration is read-only for products. By connecting Shopify, you authorize Kiln to request the `read_products` scope and process Shopify product information for imports and generation workflows. Kiln does not manage Shopify orders, customers, payments, fulfillments, inventory, or storefront settings. If Shopify sends uninstall or privacy-law webhook notices, you authorize Kiln to revoke token material and remove Shopify-sourced catalog cache records as described in the Privacy Policy.

Generated campaign and photo outputs created in Kiln remain workspace outputs after Shopify disconnect, uninstall, or shop redaction unless you delete them or request account or workspace deletion.

If you send feedback, suggestions, or ideas about Kiln, you grant Fieldwork a perpetual, worldwide, royalty-free license to use them without restriction or compensation. Do not send confidential information as feedback unless we have a separate written agreement.

Billing is not currently live. Kiln may be offered as a free, beta, trial, pilot, or early-access service unless a separate written order, plan, or checkout flow says otherwise.

If Fieldwork introduces paid plans, we will disclose material price, renewal, cancellation, and refund terms before charging you. Any automatic renewal or continuous-service plan will require your affirmative consent and will include cancellation instructions.

Do not submit payment information to Kiln unless it is requested through an official Fieldwork billing flow.

You may stop using Kiln at any time. You may request account deletion by contacting Fieldwork, subject to verification and limited retention described in the Privacy Policy.

If you uninstall the Shopify app, Kiln revokes local Shopify token material, stops future Shopify imports, and removes Shopify-sourced catalog cache records and copied Shopify product images after Shopify sends the required shop redaction webhook or within 48 hours through Kiln's uninstall safety net.

We may suspend or terminate access if we believe you violated these terms, created legal or security risk, misused Kiln, or if continued operation of the service is no longer feasible. We will use reasonable efforts to provide notice when appropriate.

The Privacy Policy explains how Fieldwork collects, uses, shares, and protects information when you use Kiln.

Kiln is provided "as is" and "as available." To the fullest extent allowed by law, Fieldwork disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Fieldwork does not warrant that Kiln will be uninterrupted, secure, error-free, or that outputs will be accurate, unique, lawful, available, or suitable for any particular campaign or use.

To the fullest extent allowed by law, Fieldwork will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or business interruption.

To the fullest extent allowed by law, Fieldwork's total liability for all claims relating to Kiln or these terms will not exceed the greater of the amount you paid Fieldwork for Kiln in the 12 months before the claim or $100.

You will defend, indemnify, and hold harmless Fieldwork from claims, damages, liabilities, losses, and expenses arising from your customer content, outputs you use or distribute, your misuse of Kiln, your violation of these terms, or your violation of law or third-party rights.

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. The state and federal courts located in New York County, New York will have exclusive jurisdiction for disputes relating to these terms or Kiln, and you consent to those courts.

We may update these terms from time to time. If changes are material, we will take reasonable steps to notify users, such as updating this page or providing an in-app or email notice. Continued use of Kiln after changes become effective means you accept the updated terms.
